Terms of Service

These Terms of Service (“Terms”) govern your access to and use of the Pulse platform, websites, APIs, and related services (collectively, the “Service”) provided by Pulse Inc. (“Pulse,” “we,” “us”). By signing up, you agree to these Terms on behalf of yourself and your organization.

1. Accounts and workspaces

A workspace is the unit of tenancy on Pulse. The first user to register a workspace becomes its Ownerand may add or remove other members and admins. The Owner is responsible for all activity within the workspace, including invited users’ actions.

You agree to provide accurate, current information when registering, to maintain the security of your credentials, and to notify us immediately of any unauthorized access. You may not impersonate another person, share your account credentials, or use the Service for any unlawful purpose.

2. Plans, billing, and trials

Paid plans are charged in advance per active seat per month, with optional usage-based add-ons described on our pricing page. An “active seat” is any user who signed in to the workspace within the prior thirty (30) days. Trial workspaces are subject to the same Terms but are not billed until you upgrade.

We may change pricing on at least thirty (30) days’ notice. If you do not accept the change you may cancel before it takes effect; cancellation does not entitle you to a refund of fees already paid.

3. Customer data and content

Pulse processes data your organization connects from third-party tools (Slack, GitHub, Notion, etc.) to deliver the Service. You retain all rights, title, and interest in your data; we obtain only the rights necessary to operate, maintain, and improve the Service for your workspace.

We do not sell your data. We do not use your data to train foundation models. Per-tenant data is isolated; we replicate the source systems’ access controls at retrieval time.

4. Acceptable use

You agree not to:

  • reverse-engineer, decompile, or attempt to extract the source code of the Service;
  • use the Service to violate any law or third-party right, including privacy and IP rights;
  • interfere with the Service’s integrity, scrape it abusively, or evade rate limits;
  • upload malware, phishing content, or content that promotes illegal activity;
  • use the Service to monitor an individual user’s personal performance. Pulse is built to describe how work flows, not to surveil people. Aggregate analytics across teams are permitted.

5. Confidentiality

Each party will protect the other’s Confidential Information using at least the same care as it uses for its own confidential information of like importance, and will use such information only to perform under these Terms.

6. Service availability and security

We aim for 99.9% monthly uptime on paid plans. We maintain administrative, technical, and physical safeguards including encryption in transit (TLS 1.2+), encryption at rest, AES-256-GCM token encryption, and SOC 2 Type II compliance. Security disclosures should be reported to security@pulse.app.

7. Termination and data export

You may cancel your subscription at any time from your workspace’s billing settings. Cancellation does not entitle you to a refund of fees already paid. Upon termination, the workspace enters a 30-day grace period during which you may export all of your data via the Pulse data-export endpoint or restore the workspace. After 30 days, all workspace data is permanently and irreversibly deleted.

8. Disclaimers

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. PULSE DOES NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED OR ERROR-FREE.

9. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, PULSE’S TOTAL LIABILITY FOR ANY CLAIM ARISING UNDER OR RELATING TO THESE TERMS WILL NOT EXCEED THE FEES YOU PAID PULSE IN THE TWELVE (12) MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM. IN NO EVENT WILL PULSE BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, OR CONSEQUENTIAL DAMAGES.

10. Governing law

These Terms are governed by the laws of the State of Delaware, USA, without regard to its conflict of laws principles. Any dispute arising from these Terms will be brought exclusively in the state or federal courts located in Wilmington, Delaware.

11. Changes

We may update these Terms from time to time. Material changes will be announced via email to workspace Owners at least thirty (30) days before they take effect. Continued use of the Service after changes take effect constitutes acceptance.
